Bid Increments: All bids MUST increment by $25 or more (e.g., if the current bid is $100, the following bid must equal or exceed $125). Making a bid will constitute an irrevocable offer to purchase, which only expires upon receipt of a valid higher bid or sale of the item.

Silent Auction Rules

Bidding
Each silent auction item has a bid sheet in front of it, with a minimum starting bid listed on the top line. Bid increments are also indicated. Silent auction bids must follow the rules on each bid sheet; i.e., the minimum bid and minimum increment for each following bid stated on the bid sheet must be followed.

Enter your bid by PRINTING your name and telephone number on the first available line of the bid sheet.

Bid sheets cannot be removed from their designated places except by authorized persons at the closing of each segment.

Bids will be accepted via fax. All fax bid forms must be sent to (212) 254-3511. See below for the fax bid form.

Bidding closes promptly at 11 p.m. on Saturday, November 20, 2004. Any bids placed after this time will be invalid. The highest bid at the close of the auction, 11 p.m., will constitute the winning bid. In the event of a dispute, one of the official MoCCA representatives shall act as the final authority and shall determine the winning bidders. His/her decisions shall be final. The determination of the “last bid” is at the sole discretion of MoCCA.

Bidders are responsible for paying for all auction items which they win. No exceptions.

Bids must include: bid amount that confirms to the bid increments indicated on each bid sheet; bidder number; and bidder initials. Bids placed without this information will be invalid.

Donors set the item value and terms of gift certificates. MoCCA is not responsible for terms as stated or changed by the donor after the fact.

Winning bidders must pick up and pay for their auction items on no later than Monday, November 22, unless other arrangements are made with MoCCA. Winning bidders are responsible for packing and transporting their items home. If any prize notification is returned as non-deliverable, winning bidder will be disqualified and an alternate winner will be selected.

Unless otherwise stated, all auction items and services must be used within the expiration date identified.

Payment
Payments may be made immediately by cash, credit card (VISA, MasterCard, American Express, and Discover) or check (made payable to the Museum of Comic and Cartoon Art). Payment must be made in full on the day of the auction.

Bidding by Fax
Bids will be accepted via fax. All fax bid forms must be sent to (212) 254-3511. See below for the fax bid form.

A credit card will be required for bidding via fax.

Bidder fax bid forms submitted after 4pm on Friday, November 19, 2004 will not be considered.

All bids must contain the Item Number, Bid Amount, Name of the Bidder & Telephone Number for the Bidder.

All bids must be for an even dollar amount. Any bids showing cents will be rounded up to the next even dollar amount.

The earliest time displayed when the fax is received will be used to determine the accepted bid when two bids for the same amount are received.

Restrictions
All sales are final and no exchanges, substitutions or refunds will be honored by MoCCA unless specifically indicated. All items in the silent auction are sold "as is" and no guarantee or warranty with respect to the property is made by MoCCA or the donors. Some items may have restrictions, which are stated in the description and cannot be changed. Please read the descriptions carefully. Many require advance reservations. Values assigned to each item are estimates only. Unless specified, all auction services must be used within one year of the date of auction.

All items involving services, tickets, events, etc. are subject to the conditions set by the donor. If you have successfully bid on any items requiring the arrangement of dates and times, we ask that you please call the donor directly and promptly so they can provide these arrangements.

Tax Deductibility
If the winning bid is higher than the fair market value (listed with each item), the difference in amounts may be deductible as a charitable contribution. Consult your tax advisor for specific information.

The Museum of Comic and Cartoon Art is a 501(c)(3) non-profit organization. Donations made through the auctions are tax deductible to the full extent of the law. Generally, auction item donations are deductible to the extent that the contribution exceeds the stated value of the item. Where the stated value is "Priceless," we suggest that you consult your tax advisor.

LIABILITY
MoCCA is not responsible for late, lost, stolen, illegible, mutilated or misdirected bids/entries or bids/entries not received by 4pm on Friday, November 19, 2004. All federal, state and local taxes are the sole responsibility of the winner. All federal, state and local laws apply. If any prize notification is returned as non-deliverable, winner will be disqualified and an alternate winner will be selected.
